Fargo Commission advances downtown convention-center proposal, TIF planning

The Fargo City Commission voted 4-1 on June 22 to rank the EAPC Kilbourne Group/Downtown Civic Center proposal first for the city’s convention-center project, moving the downtown development into negotiations but stopping short of a final project agreement or final tax-increment financing authorization.

The commission directed staff to begin immediate negotiations on a development agreement with the first-ranked proposal. It also directed the City Attorney’s Office to prepare appropriate amendments to the city’s lodging-tax ordinances.

Financing action remains preliminary

Commissioners approved the use of tax-increment financing, or TIF, funds in principle. However, the action did not itself provide final authorization for the financing. Staff were directed to identify the legal action needed to authorize TIF use and return to the commission with recommendations.

The city records cited for the June 22 action do not establish that a development agreement has been signed. They also do not state a total cost for the project. The commission’s vote therefore advances a selected proposal and negotiations rather than approving a completed agreement, construction or a final TIF appropriation.

Voter-approved lodging tax is part of plan

The convention-center effort is tied to a separate voter action. Fargo voters approved an additional 3% hotel and motel tax in November 2024, with the proceeds intended to finance construction of a convention center.

The Fargo Convention Center Committee managed the request-for-proposals process and presented a recommendation to the City Commission. The commission’s June vote set the EAPC Kilbourne Group/Downtown Civic Center submission as the first-ranked proposal in that process.

That ranking is an important procedural step because it establishes the proposal with which the city will negotiate. But several city actions remain pending, including the development agreement, lodging-tax ordinance amendments and any additional legal authorization needed for TIF financing.

Schedule and next meeting

A city Phase II schedule identifies city commission selection, development-agreement negotiations and an entitlements phase. The schedule lists development-agreement negotiations through June 16, 2026, and lists entitlements through Sept. 11, 2026.

The schedule dates should not be read as proof that an agreement was executed: the June 22 commission record directed negotiations to begin, and the available records do not document a final agreement. The city’s meeting calendar also listed a Fargo City Commission meeting for Aug. 3, 2026, though the available packet does not show that the project was finalized at that meeting.

For now, the commission has selected a first-ranked downtown proposal and authorized the next negotiation and legal-review steps. Further commission action is still needed before the records support describing the project as fully approved or its TIF funding as finally authorized.
