Puerto Rico formally adopted its 2026 State Mitigation Plan on July 23, an action the government says was required to preserve continued eligibility for specified FEMA mitigation grants and non-emergency assistance under the Stafford Act.
The executive-order portal lists OE-2026-034 as active on that date. The order adopts the plan and directs its implementation across the Puerto Rico government.
FEMA status was approval pending adoption
According to the order, FEMA Region 2 determined on June 25 that the plan was approvable pending formal adoption. The order says FEMA required Puerto Rico to adopt the plan by July 29 to continue eligibility for the specified assistance.
The order does not say FEMA had granted final approval at the time it was issued. It directs the government to complete the final-approval process.
Implementation assigned to emergency management agencies
The order assigns the Puerto Rico Emergency Management and Disaster Administration Bureau, known as NMEAD, to lead implementation in coordination with the Central Office for Recovery, Reconstruction and Resiliency, or COR3.
It directs agencies, instrumentalities, municipalities and federal partners to coordinate risk-reduction work addressed by the plan, including drainage, slope stabilization, critical infrastructure, flood risk and government continuity.
Eligibility is not a funding guarantee
The order states that continued eligibility remains subject to federal requirements and review of individual applications. It does not guarantee a particular grant award or dollar amount.
The plan is subject to a five-year review and resubmission cycle, according to the order.
